EAST KESWICK PARISH COUNCIL

 MINUTES OF THE MEETING HELD ON MARCH 17TH  2009  

POLICE AND RESIDENTS’ FORUM  There was no attendance from Police or residents.

 

PRESENT  Cllrs Priestley, Anning, Pentith, Batty and Ogden.

 

APOLOGIES   Cllrs Thornton and Pinkney.  DECLARATIONS OF INTEREST None.  MINUTES OF MEETING HELD ON 24th FEBRUARY  2009.These were approved with one addition.  MATTERS ARISING1. Village Clock The Clerk reported that she had spoken to the clock repairer at Carlton Clocks who had said that he had to date been too busy to undertake the work. It was agreed to keep pressing. Cllr Ogden would also continue to try to persuade his contact to assist.2. Chains on War Memorial  The Clerk had delayed placing an order as she had been informed of a possibility of obtaining a free chain from Norman Overfield of Bardsey who had in his possession some old chain once in use outside the Traveller’s Rest Pub and now surplus to requirements. He could provide the amount required .The Clerk brought a sample piece for Cllrs’ inspection , which, although not identical, was considered adequate for the purpose. It was therefore agreed to accept with thanks this offer and to arrange for the existing chain to be readjusted as previously agreed and the “new” section cleaned and painted to correspond. 3. Parish Paths Partnership and state of Ginnel Footpath. Rosie Watts of Public Rights of Way had written to say that her colleague had decided that the Ginnel(Footpath No 5)  was not suitable for work by his group of retired volunteers. She therefore asked for contact details of the Council’s gardener and offered to meet him on site to discuss the job. The Council, if it signed up to the Agreement, could then seek reimbursement from the Parish Paths Fund. She also supplied details of the List of Rates for 2009 for use when employing contractors to undertake works on public rights of way. It was resolved to join the Parish Paths Partnership and ask the contractor to contact Ms. Watts. 4.Boundary between lands owned by Church and by Parish Council adjacent to Tennis Courts. There was nothing to report. 5. Completion of work by United Utilities in village and Grant from LCC. Amanda White had written thanking the Parish Council for their help and co-operation and blaming the delay in completion on the weather and the loss of a day’s work due to an accident. Cllrs had not been aware of any complaints from residents since the reopening of the road. Cllr Batty had written to United Utilities on behalf of the Council asking for £40 per week in rent for use of the Crabtree Lane car park for 9 weeks. Amanda White had e mailed back saying that she would have to consult her superiors.  Cllrs queried whether all the village businesses had received and acted on their advice packs. There would be a time limit for submitting claims.The Chairman offered to contact Cllr Thornton, who had been provided with extra packs, to progress this matter.. Cllr Batty has prepared leaflets to be delivered to East Keswick and Bardsey residents advising them that all village businesses are now ready to welcome people back. Some leaflets are to be left in the pub in Scarcroft. The state in which the tarmac on the pavement had been left outside Clitheroe Cottage on Main Street was considered dangerous, and the Clerk was asked to inquire as to whether further work was likely to be carried out on maintenance of the road in the next year. 6. Agreement with Wildlife Trust. There was nothing to report.7. Cherry Tree at 12 Church Drive. The Enforcement Officer had confirmed that the tree had been cut back as requested, together with all other overhanging trees in the road. 8. Railings near Beck. Mr Hobson had promised to undertake the work now that the weather had improved. 9. Parish Assembly  The following was agreed:-·          Rosie Watts of Rights of Way would be the speaker on the Parish Paths Partnership·          Cllr Pinkney would speak on Footpaths.·          Cllr Thornton would speak on the Parish Plan.·          The Chairman would speak on Planning. ·          Cllr Batty would speak on IT.·          The Clerk would speak on Finance. ·          The Chairman would purchase the wine.·          Cllr Ogden would put out chairs and wine glasses in advance.·          The Chairman would ask Brian Dower whether he was again willing to design a suitable poster. ·          The Chairman would arrange for details of the Parish Assembly to be inserted in the next Church and Village newsletter. 10. Bin at end of Blacksmith’s Field. This has been emptied and Parks & Countryside have accepted responsibility for it. 11. Absence of Bus Stop  Sign at white railings, Main Street. Metro are looking into this. 12. Stickers for Green Bins. These have now arrived. It was agreed to ask why some households had received 2 stickers through the post in 2 separate envelopes. 13. Potholes on A569 between East Keswick and Collingham. Highways have promised to deal with these. Concern was expressed at the poor state of the road from Pasture House along Moor Lane to the Harewood Road. It was agreed to remind Highways that this needed urgent attention.14. Graffiti on Crabtree Lane Road Sign. Cllr Ogden undertook to remove this.15. Installation of WI – FI in Village Hall. The Clerk had passed to the Secretary of the Village Hall Committee details of grants suggested by Cllr Ann Castle. 16. Grant for Playground from Green Leeds. The Clerk was asked to find out how this was progressing. She had sent the grant providers the bills from Wicksteed and was aware that they would then need to inspect the new equipment before issuing the grant.  PLANNING

1.New applications:-None .

2.APPROVALS BY LCC:- None.

3.REFUSALS BY LCC:-None.

4. Enforcement Action relating to Two Hoots Farm. Mr Wiggington had e mailed a detailed report in connection with both concerns.(A)- The appeal against the  enforcement notice requiring the cessation of the use of the static residential caravan from Two Hoots Farm is proceeding. The Public Inquiry to be held at Leeds Civic Hall is likely to be on July 28 2009. A Parish Council representative may attend and make representations.

The enforcement notice requires the use of the caravan for human habitation to cease in 6 months from the date the notice comes into effect and the caravan to be removed in a further month. He lists the grounds of Mr Cobbold’s appeal and adds that the Council’s statement of its case is to go to the appellants and the Planning Inspectorate soon.

(B)His colleagues in Minerals have visited the site to establish whether the activities to separate soil and rubble amount to development in its own right, for which a fresh planning permission is required. They consider the level of the present activity to be consistent with Mr Cobbold’s claim to be recovering hard core to improve a hard standing and a farm road. They think therefore that there is insufficient evidence to show that a material change of use to waste processing has occurred, against which enforcement action could be taken. The site is however to be monitored for any significant intensification of activity. If residents become aware of vehicles bringing materials to the site and removing processed hard core/ soil they should contact Emma Hargraves in Minerals (Tel.  L 2478157) or Carlton McKenzie in Planning Enforcement (Tel. L2475914)  giving full details.

Mr Cooke is to be sent a copy of the e mail and asked whether he requires further details of the inquiry when these are known.

Cllr Ogden had noticed similar earth mounds on another farm off Harewood Avenue and wondered how Harewood Parish Council was dealing with this same problem.

It was resolved that the Clerk would write to the Clerk of Harewood PC and inquire what action they were taking.

It was resolved to pay all the bills listed above.                                                                    

  CORRESPONDENCE 1.Storage of EK Village Hall Deeds.  The Village Hall Secretary had asked the Parish Council, for the sake of posterity, to record that the deeds for the Village Hall are stored  with Hammond Solicitors via Prew Lumley.2.Notices had been received for distribution concerning a meeting organised by Outer Leeds Area Committee on Monday March 23 2009 5-6pm at Wetherby Town Hall . This is to be in the form of a discussion on the role of the local Jobs, Enterprise and Training Partnership (JET). Noted.3. “A Grave Matter” The SLCC is organising a day long course on Cemetery Management on Wednesday March 25 at Village South Leeds Hotel. Noted.

4. Next T & PC Forum Meeting – This is to be held at Linton Village Hall on Thursday March 26 at 7.30 pm. The minutes of the previous meeting and agenda for the March meeting have been circulated by e mail. Cllrs Anning and Pentith hope to attend. They agreed to bring up the problem of a resident on Whitegate who was anxious to obtain a green bin but had been informed that she was entitled only to a green sack. They would also raise the matter of the households which had received 2 separate green bin stickers by post.

 NEW BUSINESS1. Change of date for Spring Conference – P & T. Council Forum – May 13. This was noted. 2. Overhanging Hedges obscuring visibility at corner of Allerton Drive .The Chairman had received a request from a resident that these should be cut back. It was resolved to ask the Highway Enforcement Officer to deal with this matter.   MINOR MATTERS FOR DELEGATION TO CLERK/NEXT AGENDA1. Car Parking Problem at village end of Lumby Lane It was noted that 4 cars park regularly on this corner, already resulting in a number of near accidents.It was resolved to ask PCSO Louise Lodge to deal with this problem. 2. Advertising Revenue Cllr Batty produced a cheque for £80 obtained from Anchor Trust which had asked to advertise on the web site. 3. Village Hall AGM – Tuesday March 24th Cllr Pentith said that she had another commitment that evening and would be unable to act as Parish Council representative on that occasion. Cllr Ogden offered to attend in her place. 4. Speeding in village Cllr Ogden said he had noticed how speeding was now on the increase again with the opening of the road in Main Street. He had observed some solar panelled signs in another part of the country and wondered whether East Keswick could obtain some. It was resolved to ask Highways about this possibility. 5. Crime in Duke of Wellington car park Cllr Batty recounted a story of a car fight between youths who had met in the car park and resulting in the arrest of a Bardsey youth .It was considered that the incident had been drug related. Cllr Ogden confirmed that this car park is now considered to be the meeting area for drug dealing. 6. Farewell to Rev. Pearson  The Chairman wished to record that East Keswick Cllrs had attended a  farewell reception for Revd Pearson on Friday 20th February at the village Hall which was an extremely successful event. Signed:-  Date:-     EKPC March 09 Mins.
