EAST KESWICK PARISH COUNCIL

 MINUTES OF MEETING HELD ON 16TH SEPTEMBER 2008 RESIDENTS AND POLICE FORUM

No residents attended. PCSO Louise Lodge and PC Steve Lane attended on behalf of the Police. They reported only 1 crime during the last month- theft from a dwelling. The subject of parking on Lumby Lane corner was discussed again. Louise reiterated that she had no powers to take matters further. A Police Officer would have to issue any notices for obstruction. She queried how much of a problem it was. She would continue to deal with individual cases on an informal basis as they arose. This has worked in the past.

APOLOGIES  Cllrs Pentith and Ogden.  MINUTES OF MEETING HELD ON 19th AUGUST 2008   These were approved. MATTERS ARISING1. Village Clock There was nothing to report. The Clerk was asked to contact Cllr Ogden about providing an update before the next meeting. 2. Chains on War Memorial  A reminder was to be sent to Mr Hobson. 3. Parish Plan .There was nothing to report. 4. Children’s Playground .Cllr Thornton explained that after much deliberation, it had been decided that the Council should accept the Wicksteed quotation for new swings suitable for children aged 5-11, with a grass matting surface. It had been pointed out that the log train would again require moving as its new position failed to allow sufficient safety margin for the new swings. This had therefore also been built into the quotation, as Green Leeds had indicated that they were likely to offer a grant of up to £5000 if the work was done by Wicksteed as part of their contract The total amount is £4073.75 less 5% discount ,plus VAT.5. State of Overhanging Vegetation on Ginnel from Main Street to Church Drive. The Clerk had written to a number of residents whose properties bordered the Ginnel asking them to cut back their hedges. To a large extent, they had complied. Jim Dedicoat, however, felt that the work undertaken by the owners of Paddock Close was inadequate. He considered that this section of hedge needs cutting back to half its current width. Cllr Pinkney reported on the state of the section of path from Church Drive to St Mary’s Garth which was badly churned up and possibly in need of new surfacingIt was resolved to ask Grasshoppers to strim , apply weed killer, and advise on renewal of the path surface.                                                                                              Cllr Ogden had reported that the hedge on Main Street outside Laurel Mews had been cut back.6 Parish Council September Newsletter. The playground, state of hedges, retirement of the Wards, crime, the NE Area Forum and Website were to be included. Articles to Cllr Batty as soon as possible and before the end of the month.7.2009 Village Gala. Approaches have been made to possible organisers. 8. Land off Moor Lane owned by Parish Council Cllr Pinkney reported that Thomlinsons would charge £80 per hour to establish the exact boundaries of the piece of PC land and estimated it would take a maximum of 2 hours. It was resolved to authorise Thomlinsons to undertake the work for a maximum of £200. 9.Boundary between lands owned by Church and by Parish Council adjacent to Tennis Courts. Cllr Pinkney had consulted documents in the PC deed box and reported that title deeds showed a discrepancy over the boundary line between the PC and the Church land. Two of the title deeds showed a bent line (thought to be caused by the self planting of 2 large trees) and the third a straight line. Cllr Pinkney was authorised to seek the opinion of Philip Brown at Hartlaw LLP.10. Repairs to Highway – Whitegate. Mark Owens of the Highway Dept. had e mailed that the trouble with the surface was likely to be clay in the substrata which has become waterlogged with the excessive rain of the last 2 summers. He promised that it would be investigated. The Clerk was asked to request an update.

11.Farewell to Dick and Elizabeth Ward. The Chairman was making plans for the event . A possible date was discussed and it was agreed to propose Sunday lunchtime, October 19th starting at 12.30 in the Verity Room.

 PLANNING

1.New applications:-

(a) No. 08/02964/FU/HE – 3 St Mary’s Garth – Increase in Boundary Wall Height.

It was resolved to make no objection to this application.

2.APPROVALS BY LCC:-

(a) No.P/04033/FU – Port - 17 Allerton Drive – Exts.

(b) No. P/08/04136 – Dower – 3 Argyle Mews – Cons.

3. Enforcement Action relating to Two Hoots Farm. Mr Wiggington had e mailed a response to the Parish Council letter stating that an enforcement notice had been drafted in respect of the stationing of the mobile home used for human habitation and a portable office building. He expected this to be issued within the next 21 days( from 22/8/08). He claimed that the earth mounds were required for landscape purposes. He would, however, arrange for a site visit to be made to check whether they conformed to the details set out in the planning permission. It was agreed to ask for an update.

4. Enforcement Action – Old Star .A letter had been received from Mr McKenzie, Compliance Officer, stating that following  a site visit,   the publican had been informed that he should take steps to comply with the approved planning details and conditions. They might initiate enforcement action if the steps were not taken. There had been no response from John Smith’s brewery (whom it was originally believed were the owners) and Council agreed to take further steps to ascertain whether they were in fact the owners.

 It was resolved to pay the bills listed above.

* Voluntary Care to be reminded that they should use the money for visits to local doctors’ surgeries only.

2. Audit of Accounts – An e mail , following a telephone call from the External Auditors, Mazars, had asked for further documentation concerning the payments made by the Parish Council to the Village Hall Committee. On the advice of the Chairman, the Clerk had replied with an explanation of how the PWLB grant had been drawn down by the EKVHC  but had to date received no reply.     


                                                                                

 CORRESPONDENCE 1. E mail concerning Red Telephone Kiosks. YLCA had  contacted all Councils asking whether, in the event of their red telephone kiosk becoming redundant and the equipment removed, councils would wish to retain and maintain at their own expense, the empty shells. Council considered that they would wish to do so although it appeared that the East Keswick telephone box was not under closure threat at present.. 2. E mail from Shadwell Parish Council suggesting meeting of Cllrs in area. Shadwell Cllrs suggested a social meeting of local Clerks on a Saturday or in an early evening. Cllrs were agreeable, time and place being suitable. 3. YRCC Conference – November 29. Cllr Thornton urged Cllrs to attend. Dr Stuart Burgess was speaking . 4. Letter from Ramblers’ Association.  This asked the Council to affiliate to the Association for a fee of £3 a month.It was resolved to pay for one year’s membership.  NEW BUSINESS1. Plans for Remembrance Day Service linked with Bardsey Cubs. The Chairman had received a request from the Cubs to march with a banner and lay a wreath at the Memorial. The Clerk was asked to consult David Smith.2. Website .Cllr Batty reported that his firm had re-vamped the EK web site making it much more up to date and easier to operate. If there were comments and additions etc, Councillors to contact Cllr Batty direct. Thanks should be recorded to Cllr Batty for undertaking this work free of charge.   MINOR MATTERS FOR DELEGATION TO CLERK/NEXT AGENDA1. Steps from Moor Lane to The Grove It was reported that some of the flagstones were not secure.It was resolved to ask the Footpath Section to deal with the matter.2. Absence or Street Name at Harewood Road end of Lumby Lane It was resolved to request a sign.3. Photos taken by Cllr Pentith showing inadequate clearing up by Glendales after grass cutting outside Darwent House. This was the second set of photos sent to Cllrs by Cllr Pentith at the same location. The Clerk reported that on both occasions she had passed them on to Roger Foyle, stressing that this was not satisfactory. As Mr Foyle was due to speak at the Harewood & Wetherby P& T Forum in a couple of days, Cllr Thornton, another speaker, volunteered to raise the matter with him. September 08 Mins (2)
